1. Agreement and scope
These Terms of Service are a legally binding agreement between you and Solo Satoshi LLC, a Delaware limited liability company, concerning your access to and use of the browser-based firmware utility at flash.solosatoshi.com, including its interface, firmware index, downloads, documentation, and related features, collectively the “Flasher.”
By accessing or using the Flasher, you acknowledge that you have read, understood, and agree to these Terms and the Flasher Privacy Policy. If you do not agree, do not use the Flasher.
Purchases, store accounts, and other services at solosatoshi.com are separately governed by the Solo Satoshi Terms of Service and Sale Agreement and related store policies. If these Terms conflict with the store terms concerning the Flasher, these Flasher Terms govern use of the Flasher. Store terms continue to govern product purchases, returns, refunds, and hardware warranties.
2. What the Flasher does
The Flasher lets a user select a supported Bitaxe or NerdAxe model, download a listed factory firmware image, verify the file in the browser, connect a compatible device through the browser's Web Serial interface, and write the firmware to that selected device.
The Flasher is provided as a convenience for technically capable users. It is not a remote repair service, device-management service, backup service, or guarantee that any particular firmware will be appropriate for your hardware or intended use.
3. Open-source firmware and Solo Satoshi's role
ESP-Miner and related firmware are community-developed open-source projects. Solo Satoshi may sponsor, test, document, package, distribute, or contribute code to ESP-Miner or related projects, and Solo Satoshi sells hardware that may run this firmware. These activities do not mean Solo Satoshi is the sole author, maintainer, publisher, or controller of every upstream release or third-party contribution.
The Flasher identifies the upstream repository and release associated with each listed firmware image. Third-party and upstream code remains subject to its applicable open-source license and contributor terms.
4. Eligibility and authority
You must be at least 18 years old and legally capable of entering into this agreement. If you use the Flasher for a business or other entity, you represent that you have authority to bind that entity, and “you” includes both you and that entity.
5. Your responsibilities
You are responsible for:
- identifying the exact miner model, board revision, chip, and required firmware before installation;
- reviewing upstream release notes, known issues, and compatibility information;
- using a reliable data-capable USB cable, stable electrical power, adequate cooling, and a supported desktop browser;
- recording important configuration and payout information before installation;
- not disconnecting power or USB while a write is in progress;
- confirming that you have authority to modify the connected device;
- following manufacturer instructions, electrical codes, safety requirements, and applicable law; and
- testing the device safely after an update before leaving it unattended.
Your selection in the Flasher is an instruction to install that firmware. Solo Satoshi cannot physically inspect your device or independently confirm that your selection matches the connected hardware.
6. Firmware installation risks
Changing firmware can fail or produce unexpected behavior. Risks include an unresponsive or “bricked” device, loss or corruption of settings, inability to boot, reduced stability, altered thermal or fan behavior, higher power consumption, lower performance, security defects, pool connection failures, lost mining time or rewards, and the need for manual recovery or hardware repair.
Prerelease firmware is intended for testing and may be less stable, less thoroughly tested, or more likely to require recovery than a stable release. Stable firmware remains the recommended choice unless you understand and accept the additional risks of beta testing.
The preserve-settings option avoids writing the designated settings partition. It is not a backup and does not guarantee that existing settings remain compatible with a new firmware version. You should retain an independent record of settings needed to restore operation.
Firmware, mining hardware, networks, pools, and browser APIs change over time. A release that works for one board revision or configuration may not work for another.
7. Hardware sales and warranties
Solo Satoshi's role as a hardware seller is separate from the community's development of open-source firmware. Purchasing hardware from Solo Satoshi does not create a warranty for third-party firmware or guarantee continued compatibility with every future release.
Hardware warranty, return, and refund rights are governed by the policy in effect for your purchase, including the Solo Satoshi Refund, Return, and Warranty Policy and any applicable manufacturer warranty. Installing firmware does not automatically eliminate rights that cannot be waived by law. Damage or malfunction caused or materially contributed to by incompatible firmware, improper flashing, overclocking, undervolting, unsafe configuration, or misuse may be excluded to the extent stated in the applicable warranty policy.
Contact support before attempting recovery if you believe a device sold by Solo Satoshi has a covered hardware defect.
8. Verification and security limitations
The release process and browser perform checks intended to detect incomplete, corrupted, or mismatched files, including source restrictions, expected file size, and SHA-256 verification. These checks verify that a downloaded file matches the listed file. They do not prove that firmware is defect-free, safe for every configuration, free from unknown vulnerabilities, or appropriate for your hardware.
You must stop if the Flasher reports a verification error, unexpected model, interrupted connection, or other warning. Do not attempt to bypass a safety or integrity check.
9. Open-source licenses and intellectual property
The Flasher application is made available under the GNU General Public License version 3 only. Firmware and third-party components are provided under their respective licenses. Corresponding source code, notices, and license copies are available on the Licenses and Source page.
Open-source licenses govern your rights to copy, modify, and redistribute covered code. These Terms do not reduce rights granted by an applicable open-source license. No trademark license is granted. Solo Satoshi names, logos, branding, legal documents, and materials outside the licensed software remain owned by Solo Satoshi or their respective owners and may not be used in a way that implies endorsement or affiliation without permission.
10. Acceptable use
You may not use the Flasher to:
- access, modify, or interfere with a device without authorization;
- distribute malware or intentionally harmful firmware;
- bypass access controls, integrity checks, source restrictions, or other security features;
- probe, overload, disrupt, or impair the Flasher or its infrastructure;
- misrepresent a modified service or firmware image as an official Solo Satoshi or upstream release;
- violate export, sanctions, intellectual-property, privacy, computer-access, or other applicable laws; or
- infringe the rights or endanger the property or safety of another person.
11. Third-party services and projects
The Flasher relies on or links to GitHub, Cloudflare, upstream repositories, browser vendors, device drivers, and other third-party services or projects. Their terms, policies, availability, and security practices are controlled by those parties. Links are provided for convenience and source transparency and do not constitute a warranty of third-party content.
12. Changes, suspension, and availability
We may update, correct, limit, suspend, or discontinue any part of the Flasher, its device list, or its mirrored firmware at any time. We do not promise that a particular model, firmware version, or upstream project will remain available. We may block access or remove content when reasonably necessary for security, legal compliance, abuse prevention, or protection of users.
13. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE FLASHER, ITS CONTENT, AND THIRD-PARTY OR OPEN-SOURCE FIRMWARE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. SOLO SATOSHI DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, COMPATIBILITY, ACCURACY, AND QUIET ENJOYMENT.
SOLO SATOSHI DOES NOT WARRANT THAT THE FLASHER OR FIRMWARE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, SUITABLE FOR A PARTICULAR DEVICE OR PURPOSE, OR FREE OF HARMFUL OR UNDOCUMENTED BEHAVIOR. SOLO SATOSHI DOES NOT WARRANT OR GUARANTEE HASHRATE, UPTIME, POWER USE, PROFITABILITY, BLOCK DISCOVERY, MINING REWARDS, OR RETURN ON INVESTMENT.
Nothing in these Terms limits an express written hardware warranty or a right that cannot lawfully be excluded.
14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SOLO SATOSHI, ITS AFFILIATES, CONTRIBUTORS, LICENSORS, SUPPLIERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, SETTINGS, USE, PROFITS, REVENUE, GOODWILL, MINING TIME, MINING REWARDS, DIGITAL ASSETS, BUSINESS OPPORTUNITY, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATING TO THE FLASHER, FIRMWARE, OR YOUR DEVICE, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF SOLO SATOSHI AND ITS AFFILIATES FOR ALL CLAIMS ARISING FROM OR RELATING TO THE FREE FLASHER SERVICE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED UNITED STATES DOLLARS (US $100).
Some jurisdictions do not allow certain warranty exclusions or liability limitations. In those jurisdictions, these provisions apply only to the greatest extent permitted by law. Nothing excludes liability that cannot legally be excluded, including liability for fraud, willful misconduct, or death or personal injury caused by negligence where applicable law prohibits that exclusion.
15. Indemnification
To the extent permitted by law, you agree to indemnify, defend, and hold harmless Solo Satoshi, its affiliates, and their officers, directors, employees, and agents from third-party claims, losses, liabilities, damages, costs, and reasonable attorneys' fees arising from your unauthorized or unlawful use of the Flasher, your breach of these Terms, your violation of another person's rights, or firmware or devices that you modify or distribute. This obligation does not apply to the extent a claim was caused by Solo Satoshi's own conduct for which indemnification cannot lawfully be required.
16. Governing law and disputes
These Terms and disputes arising from them or the Flasher are governed by the laws of the State of Texas and the United States, without regard to conflict-of-law rules. Subject to mandatory consumer rights, the state and federal courts located in Montgomery County, Texas have exclusive jurisdiction.
Before filing a legal proceeding, you agree to contact Solo Satoshi and attempt in good faith to resolve the dispute informally for at least 30 days. This requirement does not prevent a party from seeking urgent injunctive relief. Nothing in this section removes rights or remedies that cannot be waived under the mandatory law of your place of residence.
17. General terms
Changes
We may revise these Terms by posting an updated version and changing the last-updated date. Changes apply prospectively. Continued use after the effective date means you accept the revised Terms.
Termination
You may stop using the Flasher at any time. We may restrict access for a violation of these Terms or for a lawful security or operational reason. Provisions concerning licenses, disclaimers, liability, indemnification, governing law, and general interpretation survive termination.
Severability and waiver
If a provision is held unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions continue in effect. Failure to enforce a provision is not a waiver.
Assignment
You may not assign these Terms without our written consent. Solo Satoshi may assign them as part of a merger, reorganization, sale of assets, or transfer of the Flasher service.
Entire agreement
These Terms, the Flasher Privacy Policy, applicable open-source licenses, and any expressly incorporated store policy form the agreement concerning your use of the Flasher. An open-source license controls if these Terms conflict with rights granted for covered software.
